Terms of Service

1. Agreement to Terms

By accessing or using everygame.gg (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

The Service is operated by an individual sole trader ("we", "us", "our") based in Sofia, Bulgaria. It is not operated by an incorporated company.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 16, you are not permitted to create an account or submit any personal information.

3. User Accounts

3.1 To access certain features you must register for an account. You agree to provide accurate, current, and complete information and to keep it up to date.

3.2 You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorised use.

3.3 You may create an account using your email address and a password, or via a supported third-party provider (Google, Steam). By using a third-party provider, you also agree to that provider's terms of service and privacy policy.

3.4 You may delete your account at any time through your account settings. Upon deletion, your personal data will be removed from our systems within 30 days, subject to any legal retention obligations.

4. User-Generated Content

4.1 The Service allows you to submit reviews, ratings, game lists, comments, and other content ("User Content").

4.2 By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to use, reproduce, display, distribute, and adapt your User Content solely in connection with providing and promoting the Service.

4.3 You retain ownership of your User Content. You represent and warrant that you have all necessary rights to grant the above licence and that your User Content does not violate any law or third-party rights.

4.4 We reserve the right to remove User Content that, in our sole judgement, violates these Terms, applicable law, or is otherwise harmful to the Service or its users.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations;
• Post false, misleading, defamatory, or harmful content;
• Impersonate any person or entity or misrepresent your affiliation with any person or entity;
• Scrape, crawl, or automatically index the Service without our express written permission;
• Attempt to gain unauthorised access to our systems or to another user's account;
• Transmit viruses, malware, or any other malicious or harmful code;
• Harass, abuse, threaten, or harm any other user;
• Post spam, unsolicited commercial messages, or chain letters.

Breach of these rules may result in immediate suspension or termination of your account.

6. Third-Party Content and Links

6.1 Game information, artwork, and data are sourced in part from IGDB and its contributors. All game titles, artwork, and trademarks belong to their respective owners. We make no claim of ownership over any third-party game assets.

6.2 The Service displays pricing and availability information sourced from third-party digital storefronts. This information is provided for informational purposes only. Prices and availability may vary by region and storefront. We do not guarantee the accuracy, completeness, or timeliness of any pricing data.

6.3 The Service contains links to third-party websites, applications, and stores. We have no control over, and accept no responsibility for, the content, privacy practices, terms, or availability of those third-party destinations.

7. Affiliate Disclosure

Some links on the Service are affiliate or referral links. If you click such a link and make a purchase, we may receive a commission at no additional cost to you. Affiliate relationships do not influence our game ratings, reviews, or editorial content, which remain independent.

8. Intellectual Property

8.1 The Service and its original content (excluding User Content and third-party game data), features, design, and functionality are owned by us and protected by applicable intellectual property and other laws.

8.2 You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works of any part of the Service without our express written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. PRICING AND AVAILABILITY DATA IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND WE DO NOT WARRANT ITS ACCURACY OR COMPLETENESS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

Nothing in these Terms limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot lawfully be limited or excluded under applicable law.

11. Indemnification

You agree to indemnify, defend, and hold us harmless from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of or access to the Service; (b) your User Content; or (c) your breach of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or prior notice, if we reasonably believe you have violated these Terms or applicable law. Upon termination, your right to use the Service ceases immediately. Sections 4.2, 8, 9, 10, 11, and 13 of these Terms survive termination.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Bulgaria, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of Sofia, Bulgaria.

If you are a consumer resident in the European Union, you also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date and, where appropriate, via email. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
